Child Support

Child support is based on a statute which sets forth a mathematical formula for calculation; it is called “guideline child support.” The court, Department of Child Support and most attorneys have various computer programs which assist them in calculating this guideline amount, which varies slightly depending upon which software program is being used, and is based primarily upon each parent’s (1) custodial time with the children (2)  gross monthly income - the computer itself adjusts for taxes and, if a parent is not working or only working part-time, unless s/he receives some sort of disability income or has a doctor’s letter verifying that s/he is unable to work, that parent will be “imputed” minimum wage; also, whether a parent is working full-time, part-time or not working, s/he can be imputed the “ability to earn” more than what s/he is actually earning, if his/her previous earnings were higher, or if s/he possesses education or other work skills that would place him/her in a higher wage bracket (3) and other factors including, but not limited to, the amount each parent pays for health insurance, union dues, mandatory retirement, and whether either parent is supporting his/her child(ren) from another relationship.
